Terms of Use

1. Purpose and acceptance

These Terms of Use (the "Terms") govern access to and use of the TV Mark mobile application (the "App") and its related services, published by Guillaume Paul Raoul Bourlart, sole proprietor trading as Mobiverse Games (the "Publisher"). By creating an account or using the App, you fully accept these Terms. If you do not agree to them, you must refrain from using the App.

2. Description of the service

TV Mark is a TV show and movie tracking app that lets you, among other things:

• search for shows and movies and browse their pages (metadata, cast);
• keep a personal library (watchlist, watching, finished, dropped…) and check off watched episodes;
• view a release calendar and receive notifications about new episodes;
• view personal viewing statistics;
• create lists, comment and react with the community;
• import an existing history (for example a TV Time export) and export your data, free of charge.

Metadata is provided by third-party sources, mainly TheTVDB (see the Credits page). TV Mark does not host, stream or provide access to any audiovisual content: the App is a personal tracking tool.

3. User account

Accounts are created using Google, Apple, or an email address and password. A "guest" mode is also available: in guest mode your data is stored locally on your device only, with no account and no cloud synchronization. You agree to:

• provide and maintain accurate information;
• keep access to your device and your account confidential;
• not create an account for someone else without permission, nor impersonate anyone;
• be at least 18 years old. TV Mark does not currently offer access through parental consent.

You may delete your account at any time from the App's settings. Deletion erases your data as described in the Privacy Policy.

4. Premium subscription

Some features are reserved for the paid "Premium" subscription. Purchases are made exclusively through the app stores (Apple App Store, Google Play) and technically managed by our service provider RevenueCat:

• prices, trial periods and subscription durations are displayed in the App before any purchase;
• the subscription renews automatically unless cancelled at least 24 hours before the end of the current period;
• management and cancellation are done from your App Store or Google Play account settings;
• refunds are governed by Apple's and Google's policies; we can assist you with your request;
• where applicable law so provides, you consent to the immediate performance of the service and acknowledge the rules applicable to the right of withdrawal for digital content and services.

5. Advertising

The free version of the App may display ads served by Google AdMob. Personalized advertising is subject to your consent, collected in accordance with applicable law (see the Privacy Policy). The Premium subscription removes advertising.

6. User-generated content

The App lets you publish content (comments, replies, public lists, profile elements — the "User Content"). You remain responsible for the User Content you publish. In particular, you agree not to publish any content that is:

• illegal, defamatory, abusive, hateful, discriminatory, harassing or threatening;
• infringing third-party rights (copyright, trademarks, image rights, privacy);
• advertising, spam, phishing, or containing malicious links;
• revealing plot elements without using the "spoiler" tag provided by the App.

By publishing User Content, you grant the Publisher a non-exclusive, worldwide, royalty-free license to host, reproduce and display that content, strictly as necessary for the operation of the service, for as long as it remains online.

7. Moderation and reporting

Any user can report content from within the App. The moderation team may, at its discretion and without prior notice: hide, restore or remove content; restrict, suspend or ban an account in the event of a breach of these Terms; and forward manifestly unlawful content to the competent authorities. An automated mechanism may temporarily place content "under review". Moderation decisions are logged. If you believe a decision is unfounded, you can contact us at the address given in Section 12.

8. Intellectual property

The App, its visual identity, logos and code are protected by intellectual property law and remain the exclusive property of the Publisher. Metadata and artwork of the referenced works (posters, banners, photographs) belong to their respective owners and are provided by third-party services, notably TheTVDB. If you are a rights holder and want content removed, use the Rights Holder Portal or follow the copyright takedown procedure.

9. Availability and changes to the service

The Publisher endeavors to keep the App continuously available, without being bound by an obligation of result. Interruptions (maintenance, incidents, reliance on third-party services such as Firebase, TheTVDB, RevenueCat) may occur. The Publisher may change, suspend or discontinue all or part of the service; in the event of a permanent shutdown, users will be informed with reasonable notice and will be able to export their data.

10. Liability

The App is provided "as is". The Publisher does not guarantee the accuracy or completeness of metadata provided by third parties (air dates, synopses, artwork…). To the extent permitted by law, the Publisher shall not be liable for indirect damages, loss of data attributable to a third party, or use of the App that does not comply with these Terms. Nothing in these Terms excludes the Publisher's liability in the event of gross negligence, willful misconduct, or infringement of the rights you enjoy as a consumer.

11. Termination

You may stop using the App and delete your account at any time. The Publisher may suspend or terminate an account in the event of a breach of these Terms, after notice except in urgent cases (manifestly unlawful content, threat to the security of the service). The sections on intellectual property and liability survive termination.

13. Governing law and changes to the Terms

These Terms are governed by French law, without prejudice to the mandatory consumer-protection provisions of your country of residence. In the event of a dispute, an amicable solution will be sought before any court action; you may also use the European online dispute resolution platform. The Publisher may amend these Terms; any substantial change will be notified in the App at least 15 days before it takes effect. Continued use after that date constitutes acceptance.
